Activision wins court case

THE BUZZ: Activision has won a court case against the man who brought the domain and then redirected it to the Battlefield 3 homepage.

Back in July Anthony Abraham brought the domain and then redirected the site to the Battlefield 3 official homepage, later the site began running an anti-Call of Duty propaganda campaign.

Activision stated in its legal documentation;

“It appears that the Respondent supports the game Battlefield from the game developer Electronic Arts (“EA”),”

“EA is one of Complainant’s principal competitors in the video game industry, and Battlefield game competes in the marketplace with Complainant’s MODERN WARFARE games and its other military-themed shooter games in the CALL OF DUTY series.”

Activision was required to prove that the domain name was either identical or confusingly similar to their trademark and seeing as the panel ruled in their favor I’d guess they managed to do that pretty easily.

EGM’s TAKE: This man obviously isn’t a fan of Call of Duty and although what he did was funny it was also stupid on his part, he didn’t really expect Activision to just let something like this slide.
