Court Denies Bethesda Fallout MMO Injunction

THE BUZZ: The United States Court of Appeals has denied Bethesda’s latest appeal for an injunction against Interplay’s Fallout MMO.
Bethesda aimed to show that, ”the district court abused its discretion and misapplied the law in concluding that Bethesda failed to establish a likelihood of irreparable harm.” Bethesda also tried to prove that Interplay has unstable financial footing after a recent threat of bankruptcy. Interplay originally created the Fallout brand and as a result still own some of the assets.
EGM’s TAKE: Legal battles between game companies always turn nasty due to the amount of assets that are tied to each IP. We understand Bethesda’s concern though, should the MMO not live up to their excellent stand alone games.
